  • use the Trakking digital marketplace and services for trucking companies, importers, exporters, and shipping lines (the “Platform”),

Trakking collects information about you from different sources.

We collect personal information directly from you when you sign up to use our Platform, use our Platform to source and manage containers, register to attend a seminar, participate in a survey, interact with us at trade shows or conventions or other industry events, or ask to join our mailing list, or opt-in to product promotions.

  • Personal information we receive from others.   • Financial account information, such as payment information, bank account details or check information, information on outstanding payments, credit limit, and available balance.
  • Your preferences, interests, and affiliations, such as the Trakking services you’d like to learn more about, communication preferences, or your order preferences.
  • Communications, such as when you send us email, engage with us on social media platforms, or request support.
  • Audio, electronic, and visual information, including voicemail recordings you provide or photographs or video we capture at industry events.

Trakking may create de-identified personal information. Data in this state cannot be used to infer information about, or otherwise be linked to, a particular individual. Unless allowed under applicable law, we will maintain such information in a de-identified state and will not try to re-identify the individual.

Some of the information we collect, depending on our interactions, may qualify as “sensitive” under certain privacy or data protection laws. For example, if you register for our events, you may choose to provide information that reveals a physical condition to request accommodations. Credentials and financial account information may also be considered 'sensitive' personal information.

4. COOKIES AND TRACKING TECHNOLOGY

Our websites, the Platform, and our emails use cookies and similar technology (collectively, “tracking technologies”). These tracking technologies automatically collect personal information about your internet activity, digital interactions, and your device (e.g., the pages you view, the links you click, actions you take on the Platform, IP address, log files, browser type, browser language, referring/exit pages and URLs, pages viewed, whether you opened an email, links clicked, .etc.).

  • A cookie is a small data file, which often includes a unique identifier, that we transfer to your device's hard disk (such as your computer or smartphone) for various purposes.
  • Web beacons are small tags placed in digital content, for example on a website or email, to track how the user interacts with the content. Such interaction will trigger a transfer of information that can be used to gain insight, such as how many people have viewed the content.
  • Pixels and web tags are encoded in digital content to enable functionality and/or to track engagement with digital content across contexts.

The length of time a cookie will stay on your browsing device depends on whether it is a "persistent" or "session" cookie. Session cookies will only stay on your device until you stop browsing the website that has set the cookie. Persistent cookies stay on your browsing device after you have finished browsing a particular website, until they are deleted or until they expire.

  • Platform features. When you log into your account, you may edit your information, change your password, or implement two-factor authentication.
  • Use browser controls. Most browsers provide settings to control your interactions with cookies, which will impact the information processed by cookies on our digital properties. Please refer to your browser for information on how to access these settings. Your settings may impact your experience with our websites and Platform and the functionality available to you.
  • Unsubscribe. With each marketing communication, you will be given the opportunity to opt-out of receiving future marketing notices. You may also opt-out of receiving future marketing notices by contacting us at support@trakking.com. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or by sending us an email), we reserve the right to contact you for non-marketing purposes.

You, or someone legally authorized to act on your behalf, may make a request to exercise your rights related to your personal information. We may ask that you:

  • Provide sufficient information that allows us to reasonably verify you or your authorized representative's authority to act on your behalf. Where possible, we will attempt to verify your identity by only using we have previously collected from you, such as an e-mail address. DO NOT SEND US SENSITIVE PERSONAL INFORMATION, such as a social security number or picture of photo ID, in your initial request to exercise any rights.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and/or confirm the personal information relates to you.

We will confirm receipt of any request to exercise your rights within ten (10) days of receipt and will endeavor to respond to a verifiable request within thirty (30) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personally information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Upon request, Trakking will provide you with information about whether we hold any of your personal information. You may access, correct, or request deletion of your personal information by contacting us at support@trakking.com. We will respond to your request within a reasonable timeframe.

6. LINKS TO OTHER WEBSITES, SERVICES, AND SOCIAL MEDIA PLATFORMS

Our websites and the Platform may include links to other websites, services , and social media platforms, such as Facebook, LinkedIn, and YouTube, which are owned and operated by third parties. The personal information such third parties collect and process are subject to each third party's respective privacy policy and terms. We do not accept any responsibility or liability for third parties or their websites, including their content, practices, or privacy policies. We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and disclose personal information and other data.

7. RETENTION AND STORAGE

We consider the following factors when determining how long we retain and store your information:

  • Our legal and contractual obligations,
  • Our professional and ethical responsibilities,
  • The purpose for which your information was collected or processed,
  • Your requests to delete the information,
  • Retention periods in applicable laws and regulation, and
  • Our legitimate business purposes. We may retain your data to the extent it is necessary to prevent fraudulent activity, to protect ourselves against liability, and to allow us to enforce our contractual or other rights and to pursue available remedies and limit any damages we might sustain.

Trakking stores personal information in Canada, the United States, and in other countries or regions where we (or our service providers) do business. We take steps to process the data that we collect in accordance with this Policy's provisions and the requirements of applicable law, including those related to the cross-border data transfers.

8. SECURITY

We implement a variety of administrative, technical, and physical security measures designed to maintain the confidentiality, integrity, and security of your personal information. Unfortunately, no electronic network or methods of transmitting data over the Internet can be guaranteed to be 100% secure. As a result, we cannot guarantee the confidentiality, integrity, and security of the personal information we process.

9. CHILDREN PRIVACY

We do not knowingly collect or solicit any information from anyone under the age of 16. In the event that we learn that we have inadvertently collected personal information from a child under age 16, we will delete that information as quickly as possible. If you believe that we might have any information from a child under 16, please contact us using the contact details listed below at the end of this Policy.
